How do I prove my injury was caused by my work under the Longshore and Harbor Workers’ Compensation Act (LHWCA)?
Video Transcription
Under the Longshore Act and the Defense Base Acts, an injured individual needs to show that their working conditions that existed could have caused or did cause the injury itself, or in the alternative, the injured individual needs to show that the working conditions could have aggravated, accelerated, or contributed to a pre-existing condition that resulted in the current condition. In that situation the injury itself or condition itself should be covered under the Longshore Act.
